Derived termsFrom Wiktionary under the GNU Free Documentation License. In law, a lien is a form of security interest granted over an item of property to secure the payment of a debt or performance of some other obligation. The owner of the property, who grants the lien, is referred to as the lienor and the person who has the benefit of the lien is referred to as the lienee. The etymological root is Anglo-French lien, loyen bond, restraint, from Latin ligamen, from ligare to bind. In the United States, the term lien generally refers to a wide range of encumbrances and would include other forms of mortgage or charge. In the USA, a lien characteristically refers to non-possessory security interests (see generally: Security interest—categories). In other common-law countries, the term lien refers to a very specific type of security interest, being a passive right to retain (but not sell) property until the debt or other obligation is discharged. In contrast to the usage of the term in the USA, in other countries it refers to a purely possessory form of security interest; indeed, when possession of the property is lost, the lien is released. However, common-law countries also recognize a slightly anomalous form of security interest called an "equitable lien" which arises in certain rare instances. In the USA and Canada the word is usually pronounced /ˈliːn/, whereas in the UK and other countries it is usually /ˈliːən/. Despite their differences in terminology and application, there are a number of similarities between liens in the USA and elsewhere in the common-law world. From Wikipedia under the
GNU Free Documentation License How to put a personal lien on a company which owes me money in the UK? Q. A company owes me money (ET award) and does everything not to pay it. I have been advised to put a lien on the owner or the company as it might start to dissolve voluntarily. I would be very grateful if someone could supply me with a good website on how to put a lien on the company debtor in the UK? Sorry, I cannot find anything about the lien procedure in the UK. Many many thanks! Asked by sun - Wed Mar 21 16:18:52 2007 - - 1 Answers - 0 Comments A. You have been advised wrongly. A lien is a legal right to withhold the goods/property of another until payment is made. For example, a solicitor has the right to keep the deeds for a house he has conveyed until payment for his services has been made. If you are owed a debt, you should apply to the county court for an enforcement order. If the company still do not pay, you can instruct bailiffs to attend their company offices and take goods to the value of the debt. If the company owns property then you could register a charge at the land registry, but if they go into liquidation it would not be worth very much if they have other debts. In either event, you will need to move quickly to prevent any assets being liquidated or the… [cont.] Answered by stephen.oneill - Wed Mar 21 16:38:53 2007 How long should it take for a lien to clear on a house title? Q. I'm buying my first home. The house I'm buying was a foreclosed house and is currently owned by the government. I went through the whole house buying process. The day before the closing date and signing the final papers, the title company found a lien still on the title. I have talked to the title company a few times and they said that there's nothing I can do but wait. It has now been two weeks and I'm still waiting for this lien to clear. What's taking so long? Asked by skyblue - Thu Sep 25 16:26:31 2008 - - 8 Answers - 0 Comments A. It is more important that the lien is cleared than how long it takes. Just make sure that your lock is protected while you wait. I have worked on REO purchases where the liens took months to clear. You have to light a fire under the title agent. Get a manager on the phone. Chances are they are already aware of it, but maybe you can a better idea of exactly what is taking so long. In one case, the lien was from a previous owner (prior to the foreclosure) and the mortgage servicer was no longer in business so that even though I was able to verify that there was no money owed on the account, there was no one to issue a release of lien on the mortgage so the title agent had to obtain some sort of special purpose letter for their underwriter… [cont.] Answered by Dale H - Thu Sep 25 17:09:43 2008 How can one find out where a mortgage lien on his home originated?
Q. I am looking to find out where a lien on someone's mortgage originated. They just found out there's a lien on their mortgage but they don't recall ever putting up their house as collateral or anything. I did a preliminary search on the web, but I didn't know where to begin. Asked by daiquiria - Tue May 23 12:27:48 2006 - - 6 Answers - 0 Comments A.
